END USER LICENSE AGREEMENT

1. Definitions

Smart mineralogist is a free android software “app” hosting geoscience mineral information. “Software” or “app” refers to Smart mineralogist including its source code and assets but excluding its content. “content” is the material illustrated by Smart mineralogist such as texts and images. Yakobo is the pen name of Smart mineralogist’s developer identified as Arnold P. Ritte, citizen of Tanzania, United republic of. “We” or “Us” also refer to the developers of Smart mineralogist. “You” or “User” is the reader and user of Smart Mineralogist. The “End User License Agreement” or “EULA” refers to the content of this document. Updates to this document with regards to its previous iteration are highlighted in this text color.

2. Terms

By using this software, you are agreeing to be bound by this End User License Agreement, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this software. This software is protected by its applicable copyright and trade mark law while the content contained in this software are protected by their own applicable copyright and trade mark laws.

3. Use License

• Permission is granted to download a free copy of the software from the Google Play™ store for personal, non-commercial use only. This is the grant of a license, not a transfer of title, and under this license you may not: 

  • modify or copy the software;

  • use the software for any commercial purpose, or for any public display (commercial or non-commercial);

  • attempt to decompile or reverse engineer any source code or assets contained in Smart Mineralogist.

  • remove any copyright or other proprietary notations from the software or its content.

  • transfer the software to another person or server.

• Because this software contains copyrighted content of other owners, you are agreeing not to extract its content for any other use than personal viewing of its material. You are not allowed to archive copyrighted portions of the content and you are not allowed to copy them from from the app, or the device running the app for use in any other product or service, unless explicitly allowed to do so by the owners or license of the content.

• This license shall automatically terminate if you violate any of these restrictions and may be terminated by Us at any time. Upon uninstallation of Smart mineralogist or upon the termination of this license, you must destroy any content in your possession whether in electronic or printed format.

4. Disclaimer

The content on Smart Mineralogist is provided "as is". We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Yakobo does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the content hosted in Smart mineralogist, on its Internet website or otherwise relating to such materials or on any other websites linked to the app. Furthermore, We neither claim to represent the content owners nor do We necessarily claim affiliation with them.

5. Limitations

In no event shall Yakobo, or its suppliers, or its content owners be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the app, or the content on the app, or its affiliate services, even if Yakobo or a Yakobo authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to You.

6. Revisions and Errata

Smart mineralogist or its content could include technical, typographical, or photographic errors. Yakobo does not warrant that the software or any of its content is accurate, complete, or current. We may make changes to the software or content contained in Smart mineralogist at any time without notice. We do not, however, make any commitment to update the materials.

7. External Links

We have not reviewed all of the websites linked to Smart mineralogist and We are not responsible for the content of any such linked website. The inclusion of any link does not imply endorsement by Us towards the website nor do we earn commission for linking or directing internet traffic towards said links. Use of any such linked website is at the User's own risk.

8. Software EULA Modifications

Yakobo may revise this End User License Agreement at any time without notice. By using this app, you are agreeing to be bound by the then current version of this EULA. 

9. Governing Law

Any claim relating to Smart Mineralogist shall be governed by the laws of the country of United republic of Tanzania without regard to its conflict of law provisions.
